SMIPS Visualizer Privacy Policy

Updated: July 12, 2019.

At Zamania Consulting, LLC (ZCL), we stand behind our commitment to user privacy and security. When you use our Products, any information you share with us is used solely to analyze problems and troubleshoot the Products, we do not collect or share your personal data.

We have written this Privacy Policy to tell you about how your rights and choices are protected with respect to your information, and how you can contact us if you have any questions or concerns. Below is a snapshot of some of our important privacy practices, but please read the full Policy for more detail. If you have any questions about anything in this Policy, please feel free to reach out to us at info@zamanic.com.

Privacy Overview

The SMIPS Visualizer App ("Product") has been designed for you to securely access private medical record repositories in order to view their content and to review, comment, annotate or otherwise return feedback to the repository.

Access to medical information is strictly regulated in the United States and the rest of the world. This policy applies only to the use of the Product itself and the information we collect, not to the terms governing your access to and use of confidential private repositories.

Access to such repositories usually requires acceptance of strict terms outlined in confidentiality agreements and does not permit anonymous unsupervised access. Your activities related to a repository are typically controlled by its owners and are continually monitored by the service providers who manage them.

Except for the credentials temporarily stored on the device hosting our Products (including user IDs, passwords, security certificates) no information collected by repository owners or their agents and service providers is available to the Products and none of it is shared with third parties by us, except when required by state and federal laws as outlined below. Under no circumstances will ZCL transfer any of this information to third parties for marketing or commercial purposes.

The product does not offer in-app purchases or store your personal information beyond the cached credentials used to access repositories (such credentials are provided to you directly by repository owners and confidentiality agreements with those owners are beyond the scope of this Privacy Statement). We also do not use cookies or perform analytics on your usage patterns.

Security Overview

We encrypt all of the traffic between your device and your selected repository using TLS 1.2.

While we have implemented technical security measures designed to protect the security of any personal information we process, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your data, transmission of personal information to and from our Products is at your own risk. You should only access repositories within a secure environment.

What does this Privacy Policy cover?
This Privacy Policy covers all versions of the SMIPS Visualizer ("Product"). The terms "Zamania Consulting," "we," "us," and "our" refer to Zamania Consulting, LLC. By using the Product, you agree to the terms and conditions of this Privacy Policy.
What Personal Information do we collect?

For the purpose of this Privacy Policy, "Personal Information" means any information relating to an identified or identifiable individual. We do not obtain or retain any Personal Information relating to you within the Product except for cached credentials and diagnostic information used solely for monitoring the performance of the Product.

We do not access or store your location nor do we operate your camera and we request permission if you choose to use your microphone to support dictation or voice annotations.

Any recordings are cached locally and can be transferred securely to the repository of your choice but are never stored by us or transferred to third parties.

In case of an error while you are using the Product we may collect data from your device. This log data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the Product, the time and date of your use of the Product, and other statistics. The only purpose for the collection of this data is to monitor and improve the performance of the Product, it is never used by us to personally track you, or for sales and marketing purposes.

When you use the Product

Upon request, if we are granted access to a repository by its owner, we may extract or assist with the extraction of any audit trail that is created within that repository by your use of the Product, either as permitted by your confidentiality agreement with the owner or without restrictions if there is no agreement or the agreement does not explicitly address confidentiality or your privacy.

We may share this audit trail information with the relevant authorities if required to do so by law or in the good faith belief that such action is appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Such access is not possible via the Product itself and, being governed by third party agreements and regulations, it is beyond the scope of this Privacy Policy.

Use of the Product by Minors
The Product is intended for individuals in the healthcare industry, not minors under the age of sixteen (16). The impact of incidental use by such individuals is limited by the need for access credentials to a repository and the limited personal information collected for diagnostic purposes.
International Cross-Border Data Transfer
The Product can be used to access medical repositories located anywhere in the world. Please note that data may be transferred from or to the Product from outside your region and this access may be governed by local laws and by confidentiality agreements with repository owners. In using the Product you acknowledge that the transfer of information may occur from or to countries outside of your country of residence which may have data protection rules that are different from those of your country.
